Snus in France 2026: Nicotine Pouches Are Banned — Tobacco Snus Is Allowed for Personal Use
Short answer: nicotine pouches have been banned in France since April 1, 2026 — buying, selling, importing, carrying and using them. The ban applies to tourists too. Tobacco snus cannot be sold in France, but you may bring it for personal use.
What is banned?
The ban is based on Décret n° 2025-898 of September 5, 2025, published in France’s official journal the following day. It prohibits the transport, import, possession, offer, transfer, acquisition and use of oral products containing nicotine — nicotine pouches, but also nicotine beads, gums, lozenges, liquids and strips that are not medicines. Exempt are chewing tobacco, licensed medicines and medical devices for nicotine replacement, and foods that naturally contain nicotine.
The bans on manufacture, production and export have been suspended by the Conseil d’État, France’s highest administrative court, since December 2025. Everything else applies.
Why do some sites say March 1?
The draft decree said it would apply six months after publication, which produced “March 2026” in several early reports. The adopted text instead says it enters into force on the first day of the seventh month after publication: April 1, 2026. That is confirmed by the French government’s information site service-public.fr.
Does the ban apply to tourists?
Yes. The decree has no exemption for tourists, transit or personal use, and France’s official tourism site France.fr states that nicotine pouches may not be brought in even for personal use. Sweden’s government demanded a tourist exemption in May 2026, but none has been introduced.
What about tobacco snus in France?
Tobacco snus is a different matter. The sale of tobacco for oral use is banned across the EU except in Sweden under the Tobacco Products Directive. But bringing tobacco snus for personal use, and using it, is allowed in France. France.fr gives 1 kilogram as an indicative upper limit. That figure comes from the EU guide level for smoking tobacco — neither French customs’ travel guidance nor service-public.fr mentions snus specifically — so treat it as a guideline, not a guarantee.
| Nicotine pouches | Tobacco snus | |
|---|---|---|
| Buy in France | Banned | Banned (EU sales ban) |
| Bring for personal use | Banned since April 1, 2026 | Allowed (indicatively up to 1 kg per France.fr) |
| Use | Banned | Allowed |
| Nicotine-free pouches | Not covered — the ban applies to products containing nicotine | |
What are the penalties?
The decree refers to the penalty provisions of France’s public health code, so there is no fixed on-the-spot fine. According to an official summary of Article L.5432-1, the maximum penalty is five years in prison and €375,000, rising to seven years and €750,000 in aggravated cases such as organized crime or online sales. In principle the same maximum applies to users and sellers. Sweden’s EU minister said in April 2026 that no case of an individual user being punished was known.
What did the EU and Sweden say?
France notified the draft to the European Commission in February 2025. Six countries — Sweden, Romania, Greece, Slovakia, Czechia and Italy — filed formal objections, but the Commission did not object. In July 2026, Health Commissioner Várhelyi told Swedish MEPs the ban was justified and proportionate, given the absence of harmonized EU rules for nicotine pouches. Sweden’s government has said an EU court case is not on the table. France is not alone: Belgium has banned sales since October 2023, and the Netherlands has decided on a total ban.
Our read France shows that a member state can ban an entire product category as long as the EU lacks common rules for it — and that the Commission accepts it. That is why the revision of the Tobacco Products Directive is decisive: it determines whether nicotine pouches get a harmonized EU framework or whether more countries follow. What it means for you
- Don’t count on France as a market for nicotine pouches. The ban is broad, the penalties high, and the Commission has accepted it.
- Inform customers who travel. Retailers and brands with Nordic customers benefit from clear information that pouches may not be taken to France.
- Follow TPD3 closely. France is an early signal of what national bans can mean if the EU framework turns restrictive or is delayed.
