Regulatory Affairs and Marketing for Nicotine Pouches
Regulation sets limits on product, packaging and communication. I help you translate that into commercial decisions, with a lawyer handling the legal side.
What Swedish law requires, in brief
In Sweden, nicotine pouches are regulated under the Act (2022:1257) on tobacco-free nicotine products. In short:
- Manufacturers and importers must notify products to the Public Health Agency before they're placed on the market. Retailers must register their sales and maintain internal controls.
- Sales to anyone under 18 are prohibited.
- Marketing requires special moderation. It must not be intrusive or unsolicited, must not encourage use, and must not specifically target or depict people under 25.
- Commercial advertising on TV and radio, advertising on video-sharing platforms, and sponsorship of events are prohibited.
- A health warning is required by the Swedish Consumer Agency for marketing in print media, online and on social media.
- The Swedish Consumer Agency supervises marketing outside points of sale; municipalities supervise physical stores.
From regulation to decision
The law says what's prohibited, but rarely exactly where the line runs. That's where commercial interpretation is needed: what communication you can build a marketing plan on, which channels are reasonable, and how product pages and ads should be designed. I've written more about this in Marketing nicotine pouches online.
What I help with
- Review of communication. Product pages, ads, social channels and newsletters assessed against the moderation requirement.
- A marketing plan within the limits. Which channels and messages are reasonable for your product.
- Launch preparation. What needs to be in place: notification, labelling and internal controls.
- Where friction is likely. The Swedish Consumer Agency's 2023 review flagged, among other things, free samples, gifts that encourage use, and marketing that appeals to younger audiences.
- Other markets. The starting points can differ significantly between countries, and local legal counsel is always needed there.
Important note on my role
I am not a lawyer and do not provide legal advice. Legislation and practice change, and the assessment in individual cases is made by authorities and courts. I help you understand the commercial consequences and ask the right questions to the lawyer you engage.
